Obama Follows President Bush’s Lead



The Uighurs were captured after the U.S. invasion of Afghanistan. They received terrorist training at al Qaeda affiliated camps. These Chinese Muslim terrorists are being held at Gitmo. They have for some time been the socialist Left’s cause célèbre.

When these Chinese Muslim terrorists were captured the military took an incoherent position on them. The military said they were trained al Qaeda terrorists but their real beef was with China, not us. Federal courts have ruled they aren’t enemy combatants. Federal judge Richard Urbina then tried to order their release into the U.S.

Our government has been trying to relocate the remaining 17 Uighur’s for years to no avail. No other country will accept these terrorists. China will take them but our treaty obligations arguably forbid us from sending them to China because there is reason to believe they'd be persecuted.

Judge Raymond Randolph in a well reasoned decision overruled Judge Urbina. Holding that just because courts have the power to review whether a prisoner is properly designated an enemy combatant does not mean they have the power to order the release into the U.S. of those found not to be enemy combatants.

The Uighurs appealed Judge Randolph decision. Socialist Barack Hussein Obama’s administration has filed its response in a brief. Solicitor Gen. Elena Kagan argued -- consistent with the Bush administration position -- that the Uighurs had no right to be released into the U.S..

The brief holds to the position of the Bush Administration that a court's power to issue a remedy in a habeas case -- in the wake of the Supreme Court's mandate that the detainees have a constitutional right to seek their freedom -- is limited to a finding of eligibility for relief without an actual release from captivity while diplomatic negotiations to resettle a prisoner continue.

The DC circuit court ruled that no federal court has the authority to order release of a Gitmo prisoner into the U.S., and the solicitor general argued that that decision is correct.

The socialist Left will be enraged.  Atty. Gen. Holder raised expectations that the Uighurs would soon be released in the U.S.. Socialist Holder’s statement prompted an outraged response from Congress.

Many will give socialist Obama credit for doing the right thing for national security however, Socialist Obama only does the right thing after the right winger Republicans push him from his reliable inclination to always do the wrong thing.
