This lack of knowledge on Holder’s part may explain the pardoning of terrorists and the non prosecution of the New Black Panthers voter intimidation he was involved in.

Graham had to tell Holder that there’s no precedent for trying battlefield detainees in civilian court. The real concern is that it appears Holder is clueless on is that in a district-court trial it isn’t what’ll happen to arch terrorists like KSM, whose perpetual detention is assured; the worry is that those trials will establish precedents that’ll be exploited by lesser jihadists at their own trials later on.

Graham put Holder on the spot by asking him where he would try Osama bin Laden if he were to be captured. Holder was left hemming and hawing, saying only "it would depend." Graham kept at Holder, asking whether bin Laden would be read "Miranda rights" if captured, to which Holder said he was not sure. Graham then said this is the problem with what you are doing - "You are criminalizing the war." He told Holder that if he is going to try enemy combatants as criminals in civilian court, then he has to give people like Osama bin Laden a lawyer and Miranda rights upon capture.

What can happen with other terrorists who are less well known to the public and whose guilt, while certain to the CIA, is less provable under normal evidentiary rules? A confession in a case like that might be critical. What if he wasn’t given his Miranda rights before he confessed? What then? That’s Graham’s point, and Holder seems to want nothing to do with it or just doesn't understand.

Graham said "we are making bad history" with this decision and it will "confuse" our military personnel fighting the war as to how they can handle enemy combatants captured on the battlefield. Can they be questioned, and how is that to be done if they may wind up in a civilian court?

Is the real motive in these federal court trials another attempt to bash Bush? Is it that the KSM trial is even more of a show trial than we thought? Is this an attempt to make elitist progressive Barack Hussein Obama look tough?

What it does is make America less safe. What it does is let the terrorists know our intelligence capabilities. What is does is make America weaker so Obama can placate the liberal left of the Democrat Party.

Barack Hussein Obama predicted that professed 9/ 11 mastermind Khalid Sheikh Mohammed will be convicted and executed as Attorney General Eric Holder proclaimed: "Failure is not an option." We have seen too many lies from Obama too believe anything he says.
